Terms of sale

1. Purpose and acceptance

These Terms of sale govern the purchase of usage licences for the Shopify theme Pixelion, sold by Borja Pulido Tudela (53875848G, San Gerardo 6, Torrent, Valencia) through https://www.pixelion.es. Placing an order implies full acceptance of these terms.

2. Nature of the product: digital content

Pixelion is digital content not supplied on a tangible medium: a .zip file with the theme's code plus a licence key, delivered immediately after payment. No physical product is shipped.

3. Price and taxes

Prices are shown in euros (€) and include applicable tax. The final price is confirmed in the order summary before payment. Payment is processed securely through Stripe; Borja Pulido Tudela does not store card data.

4. Licence plans

Pixelion is sold under the following plans, each with a maximum number of Shopify stores (seats) where the licence can be active at the same time:

The licence is a one-time purchase, valid for life: there are no renewal fees, and it includes all updates to the Pixelion theme for as long as the product remains commercially available.

5. Scope of the licence

The licence grants a non-exclusive, non-transferable right to install and use the Pixelion theme on the number of Shopify stores purchased. The following are expressly prohibited:

• Redistributing, reselling, sublicensing or publicly sharing the theme's code or the licence key.
• Using the licence on more stores than purchased.
• Removing the licence-verification mechanisms built into the theme.

6. Licence verification

The Pixelion theme periodically contacts our servers to verify licence status, sending the store's .myshopify.com domain and theme id. This check is necessary to prevent unauthorised use and enforce the purchased store limit. See our Privacy policy for details on this processing.

7. Licence revocation

Borja Pulido Tudela may revoke a licence, in full or in part, when: (a) a refund has been processed under our Refund policy; or (b) fraudulent, abusive use or a breach of these terms is detected (for example, unauthorised redistribution or exceeding the store limit). Revocation means the theme will stop working on the affected stores.

8. Right of withdrawal

Because Pixelion is digital content delivered immediately, the statutory 14-day withdrawal right does not apply once the buyer gives express prior consent and acknowledges the loss of that right, as requested during checkout itself. See full details in our Refund policy.

9. Intellectual property

The source code, design and other elements of the Pixelion theme are owned by Borja Pulido Tudela. Purchasing a licence does not transfer intellectual property in the product, only a right of use as described here.

10. Limitation of liability

Pixelion is provided "as is". Borja Pulido Tudela does not guarantee compatibility with every store configuration, app or previously installed theme, and is not liable for data, sales or profit losses arising from its use, without prejudice to legally non-waivable consumer guarantees.

11. Changes

Borja Pulido Tudela may modify these terms at any time. The terms applicable to each purchase are those in force at the time the order is placed.

12. Governing law

These terms are governed by the laws of España. For consumers resident in the European Union, the mandatory consumer-protection provisions of their country of residence apply in any case.
